Um. I'm pretty sure I'd be arrested if I dressed up as Donald Rumsfeld and carried a fake assault rifle.
I don't think his rights were violated at all, he was arrested because he gave probable cause of posing a threat to public safety.
Being a "danger to self or others" will get you arrested and I'd say the police had probable cause to suspect he was.
You can walk around wearing a Bin Laden costume all day long, there have been plenty who have the last few Halloweens, just don't carry fake weapons and expect people aren't going to assume you might be dangerous.
